Referral Program

These terms and conditions (Terms) govern your participation in the Mobble Referral Program (Program). By participating in the Program, you agree to be bound by these Terms and by Mobble’s Website Terms of Use and Privacy Policy (as updated from time to time).

If you do not agree to these Terms, you must not participate in the Program.

1. Program Overview

1.1 Purpose
The Program allows eligible Mobble customers to refer new customers to Mobble and receive a reward when certain conditions are met.

1.2 Rewards Structure

  • Referrer Reward
    • For eligible Australian referrers: AUD $100 per Qualified Referral.
    • For eligible New Zealand referrers: NZD $100 per Qualified Referral.

  • New Customer Benefit
    • For new Mobble customers in Australia: AUD $100 credit applied to the first Mobble subscription invoice.
    • For new Mobble customers in New Zealand: NZD $100 credit applied to the first Mobble subscription invoice.

Unless Mobble agrees otherwise in writing, the New Customer Benefit:

  • is applied as a credit to the first subscription invoice only;
  • is non-transferable;
  • is not redeemable for cash; and
  • cannot be combined with other Mobble promotional offers, discounts or coupons.

1.3 Program Availability

The Program is currently available only to individuals who:

  • are legal residents of Australia or New Zealand; and
  • meet the eligibility criteria in section 2.

Mobble may expand or restrict the availability of the Program in other countries in the future. Any such changes will be communicated by updating these Terms and/or by notices on Mobble’s website or customer communications. Until clearly stated otherwise by Mobble, the Program is not available in any country other than Australia and New Zealand.

2. Eligibility

2.1 Referrer Eligibility

To participate as a referrer (Referrer), you must:

  • be an individual participating in your personal capacity (not in the course of a business, trade or profession);
  • be at least 18 years old;
  • be a current, paying Mobble customer with an active subscription in good standing; and
  • reside in Australia or New Zealand.

Mobble may require you to confirm these matters through a declaration (for example, via a checkbox and typed full name in an online form).

2.2 New Customer Eligibility

A referred person (Referred Customer) is eligible for the New Customer Benefit only if they:

  • are not an existing or former paying Mobble customer;
  • have not previously been referred to Mobble under this or any other Mobble referral or partner program;
  • sign up for Mobble using the unique referral link specified by Mobble; and
  • activate a paid subscription for Mobble within the time period specified by Mobble from time to time (for example, within 90 days of being referred).

2.3 Business / Partner Program

The Program is for personal referrals only. If Mobble reasonably believes that:

  • you are referring customers in the course of a business or enterprise (for example, as a consultant, reseller or agency), or
  • you should instead be participating in a Mobble partner or reseller program,

Mobble may decline or cancel referral rewards and may invite or require you to participate in a separate Mobble partner program instead.

3. Qualified Referrals

3.1 Definition of Qualified Referral

A Qualified Referral occurs when all of the following conditions are met:

  1. The Referrer is eligible under section 2.
  2. The Referred Customer completes the sign-up process for Mobble using the Referrer’s approved referral method (such as a unique link or form) and does not remove or override the referral attribution.
  3. The Referred Customer activates a paid subscription for Mobble and successfully pays at least one subscription invoice.
  4. The Referred Customer maintains an active, paid Mobble subscription for at least 30 consecutive days from activation (or any longer period specified by Mobble at the time of the referral).
  5. All requirements and procedures notified by Mobble in connection with the Program are satisfied (for example, completion of any form or declaration reasonably required by Mobble).

3.2 One Referrer Per New Customer

Only one Referrer can receive a Referrer Reward for each Referred Customer. If multiple people claim credit for the same Referred Customer, Mobble will determine which Referrer (if any) is eligible, in its sole discretion acting reasonably.

3.3 Excluded Referrals

A referral will not be considered a Qualified Referral if:

  • the Referred Customer already has, or previously had, a Mobble subscription;
  • the Referred Customer signs up under a fake identity or with incomplete or inaccurate information;
  • the Referred Customer is an existing Mobble customer simply upgrading or changing their plan;
  • the Referred Customer is the Referrer themselves (self-referral), shares the same household as the Referrer, or is part of the same organization or business entity as the Referrer;
  • the referral arises from prohibited conduct under section 7; or
  • Mobble reasonably believes the referral has been made in bad faith, fraudulently or in breach of these Terms.

4. Earning and Payment of Rewards

4.1 Reward Approval

Once Mobble determines that a referral meets the criteria for a Qualified Referral, Mobble will:

  • approve the Referrer Reward; and
  • arrange for the New Customer Benefit to be applied to the Referred Customer’s first subscription invoice.

Mobble may carry out checks it considers necessary to confirm that the criteria for a Qualified Referral are satisfied before approving any reward.

4.2 Payment Method

Referrer Rewards will generally be paid by electronic means, such as:

  • bank transfer, or
  • payment through a third-party payment provider selected by Mobble (for example, Stripe or a similar service).

You must provide accurate payment details and any other information reasonably required by Mobble or its payment provider. If your payment details are incomplete or incorrect, payment may be delayed or may not be possible. Mobble is not responsible for any failure to receive a Referrer Reward due to your failure to provide accurate details.

4.3 Timing of Payment

Unless Mobble notifies you otherwise, Mobble will use reasonable efforts to pay Referrer Rewards after the Qualified Referral has been confirmed and any applicable waiting period has passed (for example, after the first 30 days of paid subscription).

Mobble does not guarantee that rewards will be paid within any particular timeframe.

4.4 Clawback and Adjustment

If, after a Referrer Reward has been approved or paid, Mobble reasonably determines that:

  • the referral did not, or no longer, qualifies as a Qualified Referral;
  • the Referred Customer’s initial payment was refunded or reversed;
  • the Referred Customer cancels or is terminated within the initial 30 days of their subscription; or
  • the reward was obtained through fraud, misrepresentation or breach of these Terms,

then Mobble may, acting reasonably and in accordance with applicable law:

  • cancel any pending Referrer Rewards related to that referral;
  • set off the value of any Referrer Reward already paid against future Referrer Rewards payable to you; and/or
  • request repayment of the relevant amount.

Mobble will not make any unauthorised charges to your bank account or payment card for the purpose of clawback.

5. Program Limits and Changes

5.1 Number of Referrals

There is currently no formal annual limit on the number of Qualified Referrals you may make in Australia or New Zealand. However, Mobble may:

  • introduce caps, tiers or other limits on referral numbers or total annual rewards; or
  • decline to accept additional referrals from you,

where it considers this reasonable to protect the integrity of the Program.

5.2 Changes to the Program

Mobble may modify, suspend or discontinue the Program (in whole or in part) at any time, including changing:

  • eligibility criteria;
  • reward amounts;
  • the method of calculating or paying rewards; or
  • applicable time periods and procedures.

Mobble will publish updated Terms on its website and may also notify you via email or through your Mobble account. Changes will not affect Referrer Rewards that have already been validly earned and approved before the effective date of the change, except where cancellation or clawback is permitted under section 4.4.

6. Taxes

6.1 Your Responsibility

Referral rewards may be taxable in your jurisdiction. You are solely responsible for:

  • determining whether you have any tax or reporting obligations in relation to participation in the Program and receipt of any Referrer Rewards or New Customer Benefits; and
  • complying with those obligations, including any reporting and payment of tax.

6.2 No Tax or Financial Advice

Mobble does not provide tax, legal or financial advice. Any general information or examples provided by Mobble about the possible tax treatment of rewards:

  • are for general informational purposes only;
  • may not be complete or up to date; and
  • may not be applicable to your specific circumstances.

If you are unsure about your obligations, you should seek advice from an appropriately qualified adviser.

6.3 Information Requests

Mobble may request information from you where it is reasonably necessary for compliance, audit or record-keeping purposes (for example, your full legal name, country of residence and confirmation that you are participating in your personal capacity). You agree to provide accurate information when requested.

7. Prohibited Conduct

You must not:

  • engage in any misleading, deceptive, fraudulent or unlawful conduct in connection with the Program;
  • create fake or duplicate accounts, or misrepresent your relationship with any Referred Customer;
  • spam, harass or otherwise contact people in a way that breaches applicable laws (for example, unsolicited commercial electronic messages);
  • use paid advertising that suggests you are Mobble or that you are officially endorsed by Mobble, unless Mobble has given you prior written consent;
  • offer any unauthorised discount, rebate or incentive in addition to the Program rewards;
  • use the Mobble brand, trademarks or other intellectual property except as expressly permitted by Mobble; or
  • attempt to circumvent eligibility criteria, annual limits, or any process put in place by Mobble for the Program.

Mobble may, acting reasonably, suspend or terminate your participation and cancel or claw back Referrer Rewards where it believes you have engaged in prohibited conduct.

8. Disputes and Decisions

8.1 Disputes About Referrals

If you believe a referral has not been correctly attributed to you, or a reward has not been correctly calculated or paid, you must contact Mobble within 60 days of the relevant event (for example, the Referred Customer’s sign-up or the expected payment date). After this time, Mobble may not be able to investigate or adjust the reward.

8.2 Mobble’s Determination

Mobble will review any dispute in good faith and may request additional information or evidence from you. Mobble’s decision as to whether a referral is a Qualified Referral and whether a Referrer Reward is payable will be final, subject to your rights under applicable law.

9. Privacy

9.1 Collection and Use of Personal Information

By participating in the Program, you consent to Mobble collecting, using and disclosing your personal information (including your name, contact details, account information, referral activity and payment details) for purposes including:

  • administering and operating the Program;
  • preventing fraud and abuse;
  • complying with legal and regulatory obligations; and
  • analysing and improving Mobble’s products and services.

9.2 Privacy Policy and Cross-Border Transfers

Mobble will handle personal information in accordance with its Privacy Policy, which is available on its website and may be updated from time to time. This may include the transfer of personal information to service providers located outside your country of residence, subject to appropriate safeguards.

10. Suspension and Termination

10.1 Suspension or Termination by Mobble

Mobble may suspend or terminate:

  • the Program generally; and/or
  • your individual participation in the Program,

at any time if:

  • you breach these Terms;
  • you engage in or Mobble reasonably suspects fraud, abuse, misrepresentation or other prohibited conduct;
  • Mobble reasonably believes your referrals are made in the course of a business or enterprise rather than in your personal capacity; or
  • Mobble decides, in its discretion, to discontinue or materially change the Program.

Mobble may also terminate your participation for any other reason by giving you reasonable notice.

10.2 Effect of Termination

Termination or suspension:

  • takes effect from the date specified by Mobble; and
  • prevents you from earning new Referrer Rewards after that date.

Termination does not affect Referrer Rewards that have already been validly earned and approved in accordance with these Terms before the effective date of termination, except where Mobble is entitled to cancel or claw back rewards under section 4.4.

11. Liability

11.1 No Guarantee

The Program is provided “as is” and “as available”. Mobble does not guarantee that:

  • the Program will be available at all times;
  • the Program will be error-free; or
  • any particular number of referrals or rewards will be available to you.

11.2 Limitation of Liability

To the maximum extent permitted by law, and subject to any non-excludable rights you have under applicable consumer protection laws:

  • Mobble’s total aggregate liability to you arising out of or in connection with the Program (whether in contract, tort, statute or otherwise) is limited to the total amount of Referrer Rewards actually paid to you under the Program in the 12 months preceding the event giving rise to the claim; and
  • Mobble is not liable for any loss of profits, revenue, goodwill, business opportunity, or for any indirect, consequential or incidental loss or damage.

11.3 Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold Mobble harmless from any third-party claims, losses or liabilities arising directly from:

  • your fraudulent or misleading referral activities;
  • your material breach of these Terms; or
  • your failure to comply with your own tax obligations in relation to referral rewards,

in each case only to the extent such loss is not caused by Mobble’s negligence, fraud or wilful misconduct.

12. General

12.1 No Employment or Agency

Participation in the Program does not create any employment, agency, partnership or joint venture relationship between you and Mobble. You are not authorised to make any representations or commitments on behalf of Mobble.

12.2 Assignment

You may not assign or transfer any of your rights or obligations under these Terms. Mobble may assign or transfer its rights and obligations under these Terms to another entity in connection with a restructuring, sale or transfer of business.

12.3 Severability

If any part of these Terms is held to be invalid, illegal or unenforceable, that part will be severed and the remainder of the Terms will continue in full force and effect.

12.4 Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. Nothing in these Terms limits any non-waivable rights you may have under the consumer protection or other mandatory laws of your country of residence (being Australia or New Zealand).

12.5 Entire Agreement

These Terms constitute the entire agreement between you and Mobble regarding the Program and supersede any prior or contemporaneous understandings or agreements relating to the Program.
